Higher Ground Fitness Agreement Rules

Membership:

Your membership permits you to use Higher Ground Fitness on Level 1 of the Tweed Ultima Building at 18-20 Stuart Street, Tweed Heads in accordance with this agreement only. Your membership is non-transferrable and valid only if you always adhere to the Higher Ground Fitness strict code of conduct at all times.

By completing and signing this agreement you agree absolutely to the terms and conditions of this Agreement. Any breach of this Agreement will permit Higher Ground Fitness to immediately cancel your membership without refunding any of the fees paid by you and will allow Higher Ground Fitness to immediately forfeit your security deposit ($20 deposit). If equipment is damaged or consistent breaches of the Code of Conduct persists, then an additional fee of $100.00 can be charged.

As a member you acknowledge that you enter and use the facilities and equipment of Higher Ground Fitness at your own risk. If you have any health conditions which may be a risk to your health and safety or have any concerns in relation to using Higher Ground Fitness when unstaffed, then you must not sign this agreement or attempt to use the facility when unsupervised.

This Agreement replaces any prior agreements and contains the entire understanding and agreement between Higher Ground Fitness and the Member whose details are set out at the beginning of this Agreement. You acknowledge that Higher Ground Fitness may alter the terms and conditions of this Agreement at any time and that you must accept those amendments, or your membership will be cancelled.

Membership and Security Fobs:

As part of your membership, Higher Ground Fitness will provide you with a Membership Access Fob for a deposit of $20.00. You must sign into the gym every time you visit by scanning your fob at the front door or presenting it to one of our staff as you enter.

Members must NOT:

Enter or attempt to enter the reception/office or other areas of Higher Ground Fitness marked “PRIVATE” or “STAFF ONLY.”

Attempt to adjust the audio, electrical video, security, lights or air-conditioning systems at Higher Ground Fitness.

Lend your membership security fob to any other person.

Provide other persons access to the Higher Ground Fitness facilities on their own security fob or bring non-members into the facility without permission from staff. (Only those persons with their own valid access tag may enter Higher Ground Fitness during unstaffed hours by swiping their own tag and entering singularly. Higher Ground Fitness may at its discretion terminate your membership for such a breach and forfeit your security deposit.)

Attempt to use equipment that you have not used previously or have had no instructions regarding its use, while having no capacity to do so without injury.

Attempt to carry out any exercise that ordinarily requires the assistance of another person (such as squats and bench presses) without another person (spotter) being present.

Drop weights on the floor or use equipment in an inappropriate manner.

Attempt to cover or disguise your face in any way on entry to the facilities of Higher Ground Fitness, or at any time whilst in or around the premises including entering the Tweed Ultima building.

Make excessive noise and use aggressive or offensive language while in the facilities of Higher Ground Fitness, or in any area of the Tweed Ultima Building.

Remove any equipment or items that do not belong to you from Higher Ground Fitness.

Leave any rubbish on the premises or around the Tweed Ultima building.

Smoke or consume alcohol at the Higher Ground Fitness premises or in the Tweed Ultima building.

Attempt to enter the premises or use Higher Ground Fitness if you are under the influence of alcohol or drugs (including prescription drugs).

Bring any training equipment or training instructors into Higher Ground Fitness without prior authorization from staff.

Train any other person for reward or accept training for reward whilst at Higher Ground Fitness unless such training is firstly approved of in writing by Higher Ground Fitness.

Members must always:

Bring a towel at all times to ensure the cleanliness and protection of the equipment whilst using the facilities at Higher Ground Fitness.

Wear appropriate enclosed footwear and clothing in all areas of the Higher Ground Fitness facilities.

Respect the rights of other members at Higher Ground Fitness and not harass or hassle them in any way.

Share the equipment, weights, and other facilities of Higher Ground Fitness at all times with other members.

Return equipment, weights and other items to the places and positions in which they are generally stored.

Notify Higher Ground Fitness immediately if you lose your access fob. If you do not immediately notify Higher Ground Fitness of such loss, then you will be responsible and liable for any damage or theft that may arise from the loss of your access fob. If you require a replacement access fob any time it will be available at the discretion of Higher Ground Fitness upon payment of a replacement fee of $20.00.

Notify Higher Ground Fitness (or its representatives) immediately of any changes to your address or contact details.

Notify Higher Ground Fitness (or its representatives) immediately if there are any changes to your health that may put you at risk whilst using the equipment and facilities during staffed hours and unstaffed hours.

Notify Higher Ground Fitness (or its representatives) immediately if you are aware of any equipment that may be in need of repair or may be unsafe to use.

Notify Higher Ground Fitness (or its representatives) if you observe any person loitering around or at the premises of Higher Ground Fitness or whom you suspect may be trying to illegally gain access to Higher Ground Fitness or who does not appear to be a member of Higher Ground Fitness.

Notify Higher Ground Fitness (or its representatives) if you observe anyone not using the facilities at Higher Ground Fitness in accordance with the obligations set out in this Membership Agreement or in a respectful and appropriate way.

Immediately notify the Police and/or Ambulance by way of the emergency buttons at the premises of Higher Ground Fitness if you or another member requires emergency assistance.

You agree that you will never use these buttons other than in the event of an emergency and that if you do Higher Ground Fitness security company will immediately attend the premises and you will be liable for a call out fee of $100.00. Higher Ground Fitness may at its discretion terminate your membership for such a breach and forfeit your security deposit.

You must adhere to strict sauna Code of Conduct and instructions prior to use.

Release and Indemnity:

You as a member agree to use the facilities and equipment at Higher Ground Fitness at your own risk and acknowledge that the use of those facilities and equipment may involve risk of injury whether caused by you or another person. You hereby agree to release Higher Ground Fitness, to the fullest extent permitted by law and to indemnify Higher Ground Fitness against and from all liabilities, claims, actions, proceedings and damages, expenses, costs and losses of any kind whatsoever arising out of, caused by, attributed to or resulting from any accident, damage, loss, damage to property, injury or death to any person. You as a member warrant by signing this Agreement that you are in good health both physically and mentally and that you have no medical condition or impairment that might prevent you from using the facilities and equipment at Higher Ground Fitness either when the Higher Ground Fitness is staffed or unstaffed and supervised or unsupervised, or which would make you more susceptible to harm or injury.
